Terms of Use

AGREEING TO THESE TERMS
These terms are an agreement between you and Pump It Up. By using Pump It Up you agree to them and to our Privacy Policy. If you do not agree, please do not use the app.
WHO CAN USE PUMP IT UP
You must be at least 13. If you are under 18 (or the age of adulthood where you live), you need permission from a parent or guardian, who also agrees to these terms for you.
NOT MEDICAL ADVICE
Pump It Up provides general fitness and nutrition information. It is not medical advice and is not a substitute for a doctor, physiotherapist, dietitian or other qualified professional. Plans, calorie and macro targets, goal dates and exercise suggestions are automated estimates based on the information you give, and may not suit you.
Talk to a doctor before starting any new exercise or nutrition plan, especially if you are pregnant or recently gave birth, are over 40 and new to exercise, have a heart, lung, joint, metabolic or other medical condition, have an injury, take medication, or have a history of disordered eating.
Stop exercising straight away and get medical help if you feel chest pain, faintness, dizziness, severe shortness of breath or sharp pain. In an emergency, call your local emergency number.
YOU TRAIN AT YOUR OWN RISK
Exercise carries a risk of injury, illness and, rarely, death. You choose whether to follow any plan, exercise or nutrition target, and you do so voluntarily and at your own risk. You are responsible for using safe technique, choosing suitable weights, checking your equipment and surroundings, and stopping if something feels wrong.
To the fullest extent permitted by law, you accept these risks and release us from claims arising from your use of the app or your training, except where the law does not allow this (see "Our liability" below).
YOUR ACCOUNT
Keep your sign-in details secure and tell us if you think someone else has used your account. Give accurate information: your plan depends on it. You can delete your account at any time in the app.
USING THE APP FAIRLY
Do not misuse the app: no breaking the law, harming others, uploading anything illegal or abusive, trying to access other people's data, copying or reverse-engineering the app, or overloading or disrupting it. We may suspend or close accounts that break these terms.
SUBSCRIPTIONS AND PAYMENTS
Pump It Up is a subscription app: Pump It Up Premium. There is no free version. What Premium includes is shown in the app and may change over time. It is available as a weekly or yearly subscription. Prices are shown before you buy.
Weekly and yearly subscriptions start with a 7-day free trial for new subscribers; you are not charged until the trial ends. If you cancel during the trial you are not charged, and you can no longer use the app once the trial ends. They are billed through your Apple or Google account and renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel at any time in your App Store or Google Play subscription settings and keep Premium until the end of the period you have paid for. Deleting the app does not cancel a subscription.
Refunds are handled by Apple or Google under their policies. By starting a subscription you ask for Premium to be available straight away, which means the 14-day cancellation right for digital content in the UK and EU may not apply once you have started using it. This does not affect your other legal rights.
If we change subscription prices, we will tell you in advance, and the new price applies from your next renewal. If you do not agree, you can cancel before then.
OUR CONTENT
The app, its design, plans, text, images and branding belong to us or our licensors. You may use them for your own personal, non-commercial training. Your own data stays yours, and you give us permission to use it only to provide the app as described in our Privacy Policy.
The voice coach voices were made with Kokoro (Kokoro-82M by hexgrad), used under the Apache License 2.0.
Food data: barcode lookups use Open Food Facts (openfoodfacts.org), made available under the Open Database Licence. Nutrition figures are a guide: check the pack if something looks off.
THE APP IS PROVIDED "AS IS"
We work hard to make Pump It Up accurate and reliable, but to the fullest extent permitted by law we provide it "as is" and "as available", without warranties of any kind, including that it is error-free, uninterrupted, or that you will reach any particular result. Results depend on many things outside our control.
OUR LIABILITY
To the fullest extent permitted by law, we are not liable for any injury, illness, loss or damage arising from your use of the app or from following any plan, exercise or nutrition information, or for any indirect or consequential loss, loss of data, profits or goodwill.
Where we are liable, our total liability to you is limited to the amount you paid us in the 12 months before the claim, or £100 (or the equivalent in your currency) if you have not paid us anything.
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including for death or personal injury caused by our negligence, for fraud, or your statutory rights as a consumer (for example under the UK Consumer Rights Act 2015, EU consumer law or the Australian Consumer Law).
INDEMNITY
If you break these terms or the law, and that causes a claim against us by someone else, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
CHANGES AND ENDING
We may update the app and these terms. We will tell you in the app before important changes take effect, and if you keep using the app after that, the new terms apply. You can stop using the app and delete your account at any time. We may suspend or end access if you seriously or repeatedly break these terms, or if we stop offering the app (with notice where we can).
DISPUTES AND LAW
Please contact us first, and we will try to sort any problem out. These terms are governed by the laws of England and Wales, and the courts of England and Wales can hear disputes, but if you are a consumer you keep the protection of the mandatory laws of the country where you live and can bring claims in your local courts.
If any part of these terms cannot be enforced, the rest still applies. These terms and our Privacy Policy are the whole agreement between us about the app.
